October 2011 Broker Exam - Preliminary Answers

Determining potential answers for the broker's exam questions after the test is different in a few key ways from taking the test, but none is more key than the fact that we have more than four hours. That means that we can take the time to research as much as we need to in order to get the most accurate (though still unofficial) document possible to all of you.

As always, remember that these answers represent only our opinion. The official answers will come from Customs and Border Protection in a few weeks and will be posted on their site. In other words, we probably answered the majority of the questions correctly, but these answers do not guarantee whether or not you've passed; it merely is presented as a helpful tool for broker students who are (quite understandably) eager to have any idea of where they stand.

If I score my exam based on these answers I will have gotten 23 wrong. But based on other sites answers I will have gotten 17 wrong. Ugh! I'm praying it's only 17 that I missed.

Hey,
Question #64 saying the answer is C-15.
As per the regulation 146.35(e)
"a complete and accurate customs form 214 will be submitted, as provided in 146.32, within 5 working days plus any extension granted by the port director..."
I think the answer should be A-5
anybody?

#62 - I answered fireworks (which is cited as an exception) I reasoned that fresh cut flowers will die and so I thought them to be perishable.

#64 - I put A based on the that same reg!

Grateful Ed. Your regs are out of date. If you look at the regs printed as of april 2011 it is 15 days

Q#62, I'm assuming fresh cut flowers are considered as perishable, and my answer to that one is (D) Firecrackers (they're not considered as HAZMAT according to a similar previous test question, except I don't remember which year was that)

Sweet! Looks like I should expect an 85%. Other sites suggest I got a bit higher than that.

However, I agree that for Q.62, fresh cut flowers should be considered perishable. That seems evident on its face that fresh cut flowers would be perishable ("cut and dried", if you will). That question was funny, because perishable items are not eligible for warehousing at all, and dangerous items (with the explicit exception of firecrackers) can only be stored with permission from the warehouse insurer. Warehouse insurer permission is irrelevant with regard to perishables. Thus the only thing that can be both i) entered into a a warehouse and ii) done so without permission from the warehouse insurer, would be firecrackers. I'm sticking to my guns that D is the correct answer.

According to 146.35(e) the 15 day number is correct: "(e) Submission of CBP Form 214. A complete and accurate CBP Form 214 must be submitted, as provided in §146.32, within 15 calendar days with no exceptions granted by the port director, or the merchandise will be placed in general order."

I also agree that flowers are perishable. If they are kept in a warehouse in a long time they will witter and die. Thats my thought process behind it.

Also number 64 is interesting. In my CFR the correct answer is A, 5 days. But my CFR is 2009 edition. Looking at a newer version of the CFR online, the right answer is C. Hopefully a lot of people put A so they can review the question and perhaps put the correct answers as A and C.

Either way, based on Boskage answers, I passed with a 80 percent. Hopefully CBP sends our pass/fail notice soon.

I also put A for #64, however apparently this changed with the new regulations. Should be 15 days

Ed, according to another site, the reg changed to 15 days and was published in April of 2011.

i went back and read my regs for question #64 (time to submit 214 for temporary deposit)...my regs say 15 days as well. My highlighter only highlighted the "5" in "15"!!!! In the heat of the moment I didn't see the "1"!!!

The regs on the national archive site, which are current for April 2011, state five days for 146.35(3).

its look like I did have an outdated version of the regs.. that sucks.

considering one for a protest - #28, the answer is C-3years; I answered B 2 years from the date of the initial request for extension; can you argue that if you applied for the extension the day the TIB was going to expire then it would in fact be 3 years? maybe its a stretch

Thank you for the post. My current standing is 78%. I hoping it will stand. It's my first time taking the test and I was wondering how successful if someone was to appeal an answer. Any responses would be grateful.

Hello. The response to 62 may be fireworks and not fresh cut flowers. I guess I always thought of pershiable as referring to food and viewed fireworks as dangerous. However, I can see why fireworks may be a better choice. Looking forward to Customs's answer for that question. Thanks.

On Q#24, wouldn't the country of origin be based on the significant transformation of the end-use? (answer B). Also on Q#52 - there is a published ABC's of prior disclosure by CBP that identifies prior disclosure as answer B.

Customs will publish its answers somewhere between the next two and ten weeks. I know that is a wide range, but it has varied over the last several exams.

I would love to know who is planning to protest. According to the BOS list, I had 21 wrong. Needless to say, it did not go in my favor with the CBP answer list. Now I'm down 23. I have highlighted #'s 32,45,46,52 & 57 as possible protest questions. I would love to hear some other feedback on these.

Usually Customs sends out the result notice at about the same time when the answer are posted online. Has anyone received theirs yet?
