CBP Posts April 2009 Exam Results!

For all of you who have been patiently (or not so patiently) waiting on the results of the April 2009 Customs Broker Exam, the results are posted on the CBP web site. Thank you to the anonymous commenter who alerted us that the results were posted this afternoon! Results are mailed to individuals and should be in your mailboxes in the next 7 to 14 days. Some ports also call people, so you may receive a phone call.

For those of you who purchased the Boskage Study Plans that included the detailed exam commentary, we’ll be completing that information and posting it soon. Some of you will be very excited that CBP gave credit to everyone for three questions (6, 75 & 76). Look for upcoming articles and discussions on protesting questions on the exam. Congratulations to all who passed!

Don't the goods have to originate from AUS AND US ??

I have a issues with the following: #'s 22, 24 and 64. Maybe someone can help explain?

I'm not sure why #22 is not E.
or why #24 can't be A??

Also #64 says Quota class merchandise must use ONLY ACH payment NOT cash or checks….THAT IS FALSE isn’t it? As far as I thought you can pay by check. Maybe ACH is preferable but their wording says must use ONLY.

Can someone explain?

I also got E for question 22 because it says that a visa was provided for category 347. WHy would the classification then be categroy 647. Also I agree with question 48 posting by anonymous on 5/6/09. I also got the answer as A.

I had the same problem regarding the category number. The visa issued was for category 347. I think it's pretty rational to assume then that the category would be 347. Any advice for us on this one?

Wizard Comments on Q22

We have seen several comments about the issue of the category number on Question 22.

Let's look at the situation from a real life perspective.

If you received a shipment such as this one, would you classify the goods based on the category number on the visa or would you classify based on the HTS? Answer - HTS. The rules for classification don't change when there is a potential visa involved. We determine the correct classification and then use the category that is assigned to it. If the foreign supplier and the U.S. party classifying the goods have done their jobs correctly, then the category numbers should match. If they don't match, either the classification selected isn't correct or the category on the visa is incorrect. Also note that the question asked for the correct classification and did not state, "what is the correct classification and category number."

That's one argument that can be made for Answer D.

Here is another argument for Answer D.

Answer E, 6203.49.8020, covers trousers of "other materials." Our materials - cotton and acrylic - have already been identified in prior provisions so they are not made of “other materials.” Since the provision for acrylic trousers falls after the provision for cotton, Answer D is the most correct classification.

Those are the Wizard's arguments. Let's hear some other ideas.

per the exam instructions - if you do not receive your score by Monday, May 18, 2009 - call 202.863.6544 - Broker compliance

i haven't received mine - but know the answer to whether i passed or not is coming soon.
